3. Privacy policy

In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Act 3/2018 (LOPDGDD), we inform you about the processing of personal data collected through this website.

Data controller: Vilafant Gestió SL, tax ID B65763526, josep@mul.tax

Purposes of processing and legal basis:

  • Answering enquiries received through the contact form: pre-contractual measures (art. 6.1.b GDPR).
  • Managing train and flight claims you entrust to us, using the data and documents you send us: performance of the engagement (art. 6.1.b GDPR).
  • Keeping the client database (name, email, phone, language, engagements and consents): performance of the engagement and legal obligations (art. 6.1.b and c GDPR).
  • Sending newsletters and advertising by email: only with your consent, confirmed through a link we send you (art. 6.1.a GDPR and art. 21 LSSI-CE); this is optional and no service depends on it.
  • Evidencing consents: we keep the date, text version, language, form and IP address (art. 6.1.c GDPR).

Withdrawing consent: you can stop receiving advertising at any time using the unsubscribe link in each communication or by writing to josep@mul.tax. Withdrawal does not affect prior processing.

Data retention: enquiries that do not lead to an engagement: 1 year from the last contact. Clients, claims and commercial documents: 6 years from the last accounting entry (art. 30 of the Spanish Commercial Code). Identification documents of tax or accounting advisory clients: 10 years (art. 25 of Act 10/2010). After these periods, data needed to deal with liabilities is blocked (art. 32 LOPDGDD). Encrypted copies of ID cards, passports and tickets, and document numbers: 1 year from the closure of the claim, or 18 months from the engagement if it is not recorded as closed. Advertising: until you withdraw consent; we then keep proof of your decision for 3 years.

Recipients: to process a claim we disclose the necessary data to the transport operator or the competent body. We do not disclose data to third parties for their own purposes, except where legally required. The following act as data processors: Namecheap (web hosting and email) and, if you use the website assistant, Cloudflare and Anthropic (AI assistant, see section 7).

International transfers: Namecheap, Inc. may transfer data to the United States. The applicable safeguard is the European Commission's standard contractual clauses (Decision 2021/914), included in its data processing agreement. You can request a copy from josep@mul.tax.

Journey checks: the initial check of a train delay does not ask for any personal data.

4. Cookie policy

This website does not use advertising, analytics or third-party cookies. We only store your language preference in your browser and, if you use the assistant, a conversation identifier.

5. User rights

Under the GDPR, you can exercise the following rights over your personal data:

  • Access: Obtain confirmation of whether we process your data and access it.
  • Rectification: Request the correction of inaccurate data.
  • Erasure: Ask for your data to be deleted when no longer necessary.
  • Objection: Object to the processing of your data.
  • Portability: Receive your data in a structured, readable format.
  • Restriction: Request the restriction of processing in certain cases.

To exercise any of these rights, contact us at josep@mul.tax. You have the right to lodge a complaint with the Spanish Data Protection Agency (aepd.es).

6. Contact

For any question about this legal notice or the processing of your data, you can contact us:

  • Email: josep@mul.tax
  • Phone: 644 377 787
  • WhatsApp: Message us

7. Virtual assistant (artificial intelligence)

This website offers a chat assistant whose answers are generated automatically by an artificial intelligence system (the Claude model, by Anthropic PBC), not by a person. This is disclosed in compliance with art. 50 of Regulation (EU) 2024/1689 on artificial intelligence.

Nature of the answers: they are general guidance and are neither a professional opinion nor a substitute for analysis of your specific case. Before filing any document, check the deadlines and the content of the administrative act. If you would like human assistance, you can write to josep@mul.tax or use WhatsApp.

Personal data: the text you enter is sent, through Cloudflare, Inc., to Anthropic PBC to generate the answer. Both act as data processors, under data processing agreements and standard contractual clauses for transfers outside the EEA. Anthropic does not use this data to train its models. We recommend that you do not enter tax IDs, third parties' names or other personal data that is not necessary. Legal basis: art. 6.1.b GDPR.
